These terms apply to the SMS and mobile messaging service of AVRE Studios.

In the following, AVRE Studios will also be referred to as “we,” “us,” or “our,” and the SMS and mobile messaging service as the “Service.”
1. Subject of the Service
When you explicitly sign up for our SMS and mobile messaging service, we may send you messages regarding AVRE Studios to the mobile number you have provided.
These may include, in particular, information about products, new arrivals, offers, discounts, promotions, and other marketing content. If you have consented accordingly, this may also include reminders regarding incomplete checkout processes or saved shopping carts.
Message frequency may vary.
2. Consent to Receive SMS
We generally only send promotional SMS or similar electronic messages if you have previously provided your express consent to receive them.
The processing of your mobile number for this purpose is based on your consent pursuant to Article 6(1)(a) of the GDPR and in compliance with the requirements of Section 7 of the UWG (German Act Against Unfair Competition).
Your consent is voluntary. Signing up for our SMS service is not a requirement for making a purchase or concluding a contract with AVRE Studios.
You can shop at AVRE Studios without signing up for SMS marketing.
3. Withdrawal and Unsubscribing
You may withdraw your consent to receive marketing SMS at any time with effect for the future.
Unsubscribing is possible, in particular, via the unsubscribe link provided in an SMS. If the respective technical dispatch solution supports SMS replies, you can also unsubscribe according to the instructions provided in the respective message, for example by sending the keyword STOP.

After successfully unsubscribing, you will not receive any further promotional SMS from the respective SMS program. You may receive one final confirmation message regarding your unsubscription.
The withdrawal of your consent does not affect the legality of any processing that took place based on your consent prior to the withdrawal.
4. No Obligation to Participate
Participation in the SMS service is entirely voluntary.
In particular, neither the ability to use our online shop nor the ability to order products or exercise existing customer rights depends on signing up for the SMS service.
5. Costs
AVRE Studios does not charge any separate fees for signing up for or receiving our SMS service.
Depending on your mobile plan, however, costs from your mobile service provider for SMS, mobile data, or other telecommunications services may arise. We have no influence over such costs.

6. Technical Availability
To receive our SMS, you must provide a valid and reachable mobile number.
Should your mobile number change, you may need to sign up for the service again with your new mobile number.
We strive to ensure the reliable transmission of our messages. However, the delivery of SMS is also dependent on mobile networks, mobile service providers, technical service providers, your device, and other circumstances that may lie outside our direct control.
Therefore, constant or uninterrupted availability of the SMS service cannot be guaranteed.
7. Changes or Discontinuation of the Service
We may change, further develop, or discontinue the SMS service or individual functions if there is an objective reason for doing so and your legal rights are not unreasonably impaired.
We will inform you in an appropriate manner regarding significant changes that affect your rights or the use of the service.
Changes to these terms are not deemed accepted merely by your continued use of the service if explicit consent is required under applicable law.
8. Data Protection
When using our SMS service, we process in particular your mobile number as well as information about your registration, your consent, the dispatch, and, if applicable, your interaction with our messages.

10. Legal Rights
Your legal rights as a consumer and your rights under the General Data Protection Regulation are not restricted by these terms.
The law of the Federal Republic of Germany applies, excluding provisions that would conflict with mandatory consumer protection regulations.
